Omriya
Terms of use
Last updated
These are the terms on which you use Omriya: the app for iPhone and Android, the web app, the shared list pages and omriya.app. By creating an account, opening a list somebody sent you, or buying Omriya Plus, you agree to them.
Who you are dealing with
Omriya is made and run by its developer, a sole proprietor (ФОП) registered in Ukraine. The stores show the trader details they are required to show; the way to reach us is support@omriya.app. “We” means the operator of Omriya.
What Omriya is
A wishlist for gift occasions. You keep the things you want, put some on a list, and send the list’s link to the people who buy for you. They can reserve a wish so nobody else buys the same thing, and you never find out who reserved what.
If you keep a list, you need an account, and some things cost money (see Omriya Plus). If you open a list somebody sent you, you need nothing to look and an account to reserve, so that you can cancel the reservation later and nobody else can. Reserving is free. Nobody who opens a list ever pays us anything.
Your account
You must be at least 13, or the age at which your country lets you agree to a service like this, if higher. You sign in with an emailed link, with Apple, or with Google; there are no passwords, so keep your email and those accounts safe. What is done in your account is on you until you tell us it has been taken over. One person, one account; the people you keep wishes for live inside it.
What you put in
It stays yours. You give us permission to store it, show it back to you, show a shared list to anyone who holds its link, build the preview a chat app asks for, send the mails the privacy policy describes, and make the copies that running a service requires. The permission ends when you delete the content or the account, except for backups, which expire on their own.
You are responsible for it: for having the right to use the photos and details you enter, and for being allowed to enter details about somebody else. When you paste a shop’s link, the app reads that page’s title, price and picture onto your wish; the page and its contents remain the shop’s.
What you may not do
- Put in anything illegal, anything sexual involving minors, anything that harasses or threatens a person, or spam.
- Try to find out who reserved a wish.
- Reach the service by any means other than the app, the web app and the shared list pages. No scraping, no bots.
- Copy, modify, reverse engineer or resell the app, beyond what the law allows regardless of these terms.
- Pass yourself off as somebody else, or interfere with the service or other people’s use of it.
Anyone who holds a list’s link can report a wish on it, by email. If content or behaviour breaks these terms we may remove the content, close the link, or suspend or delete the account, and we say why unless the law forbids it.
Sharing and reservations
A shared list is as private as the people you send it to. Anyone with the link can open it and pass it on. You can regenerate the link or close the list at any time; what somebody saw or saved while the link was live, we cannot take back.
A reservation is a claim, not a promise. It shows the wish as taken to everyone else; it does not mean the gift was bought, and we do not know whether it was. We sell no goods and are not a party to any purchase; a price on a wish is what its owner typed or what a shop said at the time. We hide reservations from the person the list is for, in the database, and we cannot stop the person who reserved something from telling.
Omriya Plus
The free plan holds unlimited wishes and savings goals, one person besides yourself, three active lists and three events; archived lists do not count. When you reach a limit the app offers Plus, or you can archive a list to make room.
Omriya Plus removes those three limits and adds cosmetic extras. It is sold as a monthly subscription, a yearly subscription, or a lifetime purchase paid once, which never renews. Prices are shown in the app in your store’s currency before you buy. We may change prices; for a subscription you already hold, the store tells you first, and where it requires your agreement nothing changes until you give it.
Apple or Google take the payment and hold the receipt. It is charged to your App Store or Google Play account when you confirm the purchase. A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period, and the renewal is charged within the 24 hours before that period ends. You manage and cancel subscriptions in your App Store or Google Play account settings, not in Omriya; cancelling stops the next renewal and the current period runs to its end. Refunds are handled by the store you bought from, under its rules; we never hold your money and cannot refund it ourselves. Where the law gives you a right to withdraw, you keep it.
When Plus ends you keep everything you made, and the free limits apply to what you add next. Plus is never needed to open, view or reserve on a list.
The app itself
The app, its design, its name and its code are ours. You get a personal, non-transferable licence to use the app on devices you own or control, for the purposes above. On iPhone and iPad the app is also licensed under Apple’s standard end user licence agreement; on Android, Google Play’s terms of service apply beside these.
We change the app over time and may add, change or remove features; where a change removes something you rely on, we try to say so first. We try to keep Omriya running and do not promise that it always will.
Ending the agreement
You can leave at any time by deleting your account in the app under Profile, Account, which removes everything at once. A subscription is cancelled with the store, not by deleting the account. We can end the agreement if you break these terms, saying why unless the law forbids it, or if we close Omriya down, with at least thirty days’ notice and a way to export your data.
Liability
We provide Omriya as it is. To the extent the law allows, we make no promises beyond these terms and are not liable for a gift that was not bought or was bought twice, for a list that reached somebody you did not intend, for content other people put in, or for loss caused by something outside our control. Where we are liable, our liability is limited to what you paid us in the twelve months before the event. If you are a consumer, you keep every right the law of your country gives you, and nothing here takes it away.
Law and disputes
These terms are governed by the law of Ukraine. We first try to settle any dispute by writing to each other; failing that, it goes to the courts of Ukraine. A consumer living elsewhere may bring a claim in their own courts, and their country’s mandatory consumer laws apply to them whatever this section says.
Changes
When these terms change, the date at the top changes. If a change matters, the app tells you before it takes effect; if you do not agree, delete your account before then. Using Omriya after the date means you accept the new terms.
